Acceptance of Terms

By accessing or using the Nexon platform, you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree to these terms, you may not use the platform.

If you are using the platform on behalf of an organisation, you represent that you have the authority to bind that organisation to these terms, and "you" refers to both you and the organisation.

Description of Services

We provide cloud infrastructure services for software development and deployment, including but not limited to edge functions, storage, databases, middleware, observability tools, and related developer tooling (collectively, the "Services").

We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with reasonable notice where practicable.

Account Registration

To use the Services, you must create an account and provide accurate, complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials and all API tokens associated with your account
• All activity that occurs under your account, whether or not authorised by you
• Notifying us immediately at security@nexon.app if you suspect unauthorised access

You must be at least 16 years of age to create an account. Accounts registered on behalf of minors by a parent or legal guardian are permitted on Enterprise plans.

Acceptable Use

You agree not to use the Services in any way that:

• Violates any applicable local, national, or international law or regulation
• Transmits or stores material that is unlawful, harmful, abusive, defamatory, or obscene
• Attempts to gain unauthorised access to any part of the platform or any third-party systems
• Distributes malware, ransomware, spyware, or other malicious code
• Generates or facilitates unsolicited bulk communications (spam)
• Intentionally overloads or disrupts the platform infrastructure (denial-of-service attacks)
• Mines cryptocurrency or performs computationally intensive tasks not related to your primary application workload

We reserve the right to immediately suspend or terminate any account found to be in violation of this policy without prior notice.

Billing & Payments

Paid plans are billed in advance on a monthly or annual basis. Usage-based charges (bandwidth, execution time, storage) are billed in arrears at the end of each billing cycle.

• All prices are in USD unless otherwise stated
• Invoices are generated automatically and sent to your billing email address
• If a payment fails, we will retry up to three times over 7 days before suspending your account
• Refunds are issued at our discretion for billing errors; prepaid plan fees are non-refundable except where required by law
• We reserve the right to change pricing with 30 days' advance notice

Service Availability

We target 99.99% monthly uptime for core platform services, as defined in our Service Level Agreement (SLA) available to Pro and Enterprise customers. Scheduled maintenance windows are excluded from uptime calculations.

Current service status and historical incident reports are available at status.nexon.app. We are not liable for downtime caused by third-party infrastructure providers, force majeure events, or actions taken by you or your users.

Intellectual Property

Your content. You retain all ownership rights to the code, data, and other content you deploy or store on the platform. By using the Services, you grant us a limited licence to host and process your content solely to provide the Services.

Our platform. All rights in the Nexon platform, including its design, software, trademarks, and documentation, are owned by Nexon Engineering Group. Nothing in these terms transfers any ownership to you. You may not copy, modify, or reverse-engineer any part of the platform.

Limitation of Liability

To the maximum extent permitted by applicable law, Nexon Engineering Group shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services.

Important: Our total aggregate liability to you for any claims arising from or related to the Services shall not exceed the amount you paid to us in the 12 months preceding the event giving rise to the claim, or USD $100, whichever is greater.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

Termination

You may terminate your account at any time from your account settings. Upon termination:

• Access to the platform will be revoked immediately
• All deployed resources will be deprovisioned within 24 hours
• Your data will be retained for 30 days to allow export, then permanently deleted
• Outstanding usage charges for the current billing period remain payable

We may terminate or suspend your account immediately and without notice if you materially breach these Terms, fail to pay outstanding invoices, or if required to do so by law.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Services shall be resolved by binding arbitration in Delaware, except that either party may seek injunctive relief in a court of competent jurisdiction where necessary to protect intellectual property or prevent irreparable harm.

Changes to These Terms

We may update these Terms at any time. When we make material changes, we will notify you by email or via a notice in the dashboard at least 14 days before the changes take effect.

Your continued use of the Services after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Services before the effective date.
